Australian Arbitration Survey 2026
In February 2026, ACICA, with the support of HKA and FTI Consulting, launched the 2nd edition of the Australian Arbitration Survey.
Building on the successes of the inaugural Australian Arbitration Report 2020 and the Evidence in International Arbitration Report 2023, the Australian Arbitration Survey aims to deliver the most comprehensive empirical insights into Australia’s commercial arbitration landscape to date.
Respondents are invited to share their views on both domestic and international commercial arbitration, including what works well and what can be improved. Where applicable, respondents are asked to provide insights on the drafting of arbitration clauses and to share case data from the last three years (2022–2025)*. We are also seeking perspectives on the use of Artificial Intelligence in arbitration.
*The Survey will be strictly confidential. Respondent IDs will be used solely for de-duplication and tracking completion. Respondent identities and response data are stored separately and confidentially, and survey responses will not be identifiable.
The Survey will remain open for responses until Tuesday 31 March 2026.
