ACICA Appointing Only Service

ACICA is able to act as Appointing Authority for arbitration, mediation, expert determination and other ADR proceedings, whether pursuant to the UNCITRAL Arbitration Rules or other ad hoc rules or procedures agreed by the parties.

Appointment Process

The ACICA Ad Hoc Appointment Rules 2023 (Ad Hoc Appointment Rules) apply to all applications received by ACICA for an appointment of a Third Party Neutral (including arbitrators, mediators, expert determiners or any other third party neutral).

The Ad Hoc Appointment Rules establish the process through which a party can apply to have a Third Party Neutral appointed to a dispute.

Pursuant to the Ad Hoc Appointment Rules, the ACICA Executive committee, made up of its office-bearers, considers all appointment applications. The Ad Hoc Appointment Rules set out the process undertaken to ensure any conflicted member of the ACICA Executive is not involved with the relevant application. Where parties have agreed to a procedure whereby they have expressly nominated a particular Office-Bearer (eg. the President) of ACICA to make an appointment, and that Office-Bearer has disclosed a conflict in the matter, the ACICA Executive will nominate another Office-Bearer to make the appointment in their stead.

To avoid any issues in this regard, ACICA recommends parties use the Model Clause on the ACICA website for parties adopting the UNCITRAL Arbitration Rules, as amended to incorporate any alternative ad hoc rules or procedures agreed by the parties. ACICA strongly recommends that parties obtain appropriate legal advice when negotiating and drafting arbitration clauses.

Relevant Fees

ACICA charges a non-refundable request fee and administrative fees based on the time spent by the Secretariat in connection with the engagement.
