Mediation at ACICA

ACICA acts as an appointment body for international and domestic mediations. ACICA can be referenced in contracts as the body with authority to make an appointment in circumstances where the parties are unable to reach an agreement on a mediator.  This can assist in preventing any deadlock resulting from the parties’ inability to agree on the mediator’s identity.

ACICA also administers mediations in accordance with the ACICA Mediation Rules 2007. These Rules outline the process for the commencement of the mediation, appointment of the mediator, submission of statements and termination of the proceedings.  The Rules also cover key issues such as confidentiality of proceedings and disclosure of information.

The Rules allow the parties the freedom and flexibility to agree the details of how the mediation will be conducted.
