ACICA Deposit Holding Service

ACICA is able to act as Deposit Holder, holding funds in trust for payment of Tribunal fees and expenses, in circumstances where it is not administering the dispute (although it may have acted as the appointing authority).

ACICA charges a non-refundable account administration fee for use of the deposit holder service (ACICA Deposit Holder Fee). The ACICA Deposit Holder Fee will be charged upfront for either a six or twelve month period, determined upon consultation with the Tribunal. The parties will be jointly and severally liable for payment of the ACICA Deposit Holder Fee.

As a part of this service, ACICA will provide:

  • A letter of confirmation of service, setting out the account details for the payment of Tribunal deposits to ACICA’s trust account.
  • Invoices for the payment of the ACICA Deposit Holder Fee.
  • Confirmation of receipt of the Tribunal deposits.
  • Payment of the Tribunal invoices on instruction from the Tribunal.
  • Trust account disbursement advices to the parties (copied to the Tribunal) showing payments made from ACICA’s trust account and the balance remaining.

All parties and the Tribunal must agree to the Terms prior to the provision of the Service.

Additional services
ACICA is pleased to assist Tribunal members with the following additional arrangements:

  • Printing and binding of awards
  • Provision of copies of the award to parties.

These services will be charged (as directed to either the Tribunal or the parties) at an hourly rate for Secretariat staff time plus the cost incurred with regard to the relevant service — printing, binding and courier/registered post.
